So who decides? Whether it\u2019s a little fender-bender or a serious crash, and no matter the damage, the same process determines who\u2019s responsible.<\/p>\n<h2>Bodily injury: the \u201cno-fault\u201d system applies<\/h2>\n<p>First, an important point: no-fault compensation applies only to bodily injury. Under this system \u2014 \u201cno-fault\u201d \u2014 any Quebec resident hurt in a car accident is compensated by the Soci\u00e9t\u00e9 de l\u2019assurance automobile du Qu\u00e9bec, at fault or not.<\/p>\n<h2>Property damage: your insurer weighs your liability<\/h2>\n<p>Worth knowing, too: police don\u2019t need to attend if no one\u2019s hurt, and in any case they don\u2019t determine who\u2019s responsible. That\u2019s the insurers\u2019 job, and they do it using the Direct Compensation Agreement (DCA).<\/p>\n<p>The DCA includes the Driver\u2019s Fault Chart, which lays out a range of accident scenarios (based on the Highway Safety Code) and the share of liability for each. For instance:<\/p>\n<ul>\n<li>The driver ahead brakes hard and you rear-end them. Under the DCA, you\u2019re 100% liable \u2014 the Highway Safety Code requires you to keep a safe following distance.<\/li>\n<li>You\u2019re backing out of a mall parking spot and clip another driver. Both cars are damaged. Liability splits 50\/50.<\/li>\n<\/ul>\n<p>So each driver\u2019s share of liability is set by the Driver\u2019s Fault Chart. At fault or not, every policyholder is paid for damage to their own vehicle by their own insurer, based on their liability and the coverage they bought.<\/p>\n<h2>At fault or not: what it means for your payout<\/h2>\n<p>Here\u2019s how it plays out for damage to your vehicle. If your insurer finds that:<\/p>\n<ul>\n<li>You\u2019re not at fault: even without collision coverage, you\u2019re paid for the damage under the civil liability coverage in your policy (Section A), and you pay no deductible.<\/li>\n<li>You\u2019re at fault: you\u2019re paid for the damage if you carry Collision or All-Perils coverage (Section B), and you\u2019ll pay your deductible.
